According to their reports, a series of deceitful price-fixing agreements were struck between 2016 and 2019, with companies determined to game the system before tenders even began. Andreas Mundt, president of the Bonn-based authority, revealed this unsettling truth: "Before tenders, it was agreed who would win," he explained. Other companies often submitted "dummy bids" with pre-agreed minimum amounts.

Such practices need to be kept in check, Mundt warned, as they undermine the public sector's ability to secure goods and services efficiently and affordably. "Only with effective competition can the public sector obtain goods and services economically and thriftily," he explained.

Unfortunately, these illegal cartel agreements can lead to substantial damage that ultimately impacts all citizens. In 2018 and 2019, four construction companies in Saxony, Thuringia, and Saxony-Anhalt made secret deals to divide up clients and tenders. The Federal Cartel Office reported that a special lingo was sometimes used to signal participation and double-crosses.

Things got even more dirty when, between 2016 and 2019, four companies colluded in tenders in Brandenburg and Saxony-Anhalt, with Mecklenburg-Vorpommern occasionally in the mix. Shockingly, one firm was involved in both instances.

The contracts in question covered simple road repairs, the provision of bitumen emulsion, or gravel. The order sizes usually fell between 40,000 and 200,000 euros.

Armed with evidence, the Federal Cartel Office and the Public Prosecutor's Office in Düsseldorf swooped in for several raids in 2019. One company chose to cooperate as part of the leniency program.

Gladly, these unethical dealings won't go unpunished. The greedy companies involved can expect to cough up some serious cash in fines.
