Frankfurt Main Customs Office Uncovers €61.9M in Construction Site Abuses
Frankfurt Main Customs Office's recent focus action on construction sites has led to a significant number of investigations and proceedings. The operation, conducted in 2024, targeted illegal employment, sham self-employment, and non-compliance with social security obligations and minimum wage.
The FKS inspected the employment conditions of 3,104 individuals, initiating 1,891 criminal proceedings and 887 individual cases for administrative offenses. The total damages amounted to approximately 61.9 million euros. A team of 48 customs officers and six police employees inspected 55 employers and questioned 166 employees on site.
The operation resulted in the discovery of seven employees without proper identification, leading to seven administrative offense proceedings. Six employees were also provisionally detained on suspicion of illegal residence. Among those found working illegally were three Serbian, one Albanian, one Kosovar, and one Belarusian citizen. An Albanian citizen wanted for arrest due to non-compliance with a departure order was also handed over to the police.
The investigations are ongoing, with follow-up investigations comparing on-site data with company records. A total of 61 cases showed potential non-compliance with social security notification obligations, requiring further examination. The Main Customs Office detected 71 violations of the immediate notification obligation during the inspections.
The Frankfurt Main Customs Office's focus action has uncovered numerous violations and initiated proceedings against both employees and employers. The investigations are ongoing, with the German Federal Ministry of Labor and Social Affairs or its authorized agencies expected to handle suspected violations of social security obligations and the minimum wage.
