Massachusetts imposes record-breaking sports gambling penalty on DraftKings for processing credit card wagers

In a significant move, online sports betting giant DraftKings has been fined $450,000 by the Massachusetts Gaming Commission (MGC) for violating state regulations.

The violations occurred between March 2023 and February 2024, during which DraftKings accepted over 1,100 unlawful credit card transactions amounting to more than $83,000 in sports bets. The MGC, which regulates sports betting in Massachusetts, found that these transactions were in contravention of regulations that prohibit using credit cards to fund sports betting accounts.

The MGC's investigation revealed that DraftKings' noncompliance was due to systemic compliance failures, faulty internal communication, and recurring software issues. Despite self-reporting these violations multiple times and cooperating with investigations, the MGC found that DraftKings' attempts to fix the problem, initially believed resolved in May 2023, were ineffective, as the issue recurred in February 2024.

DraftKings, headquartered in Boston, has not disputed any of the relevant facts regarding the violations. The company contends that its noncompliance was based on a fundamental misunderstanding of the prohibition at issue.

In addition to the fine, DraftKings has been ordered to refund affected customers and undergo a third-party audit to ensure no further credit card deposits occur in Massachusetts accounts in early 2023.

This fine marks the largest of its kind ever issued by the MGC.
