Nordhorn lodges objections towards DOC Ochtrup in their municipal jurisdiction
In a series of legal moves, several surrounding municipalities have coordinated their efforts to contest the expansion of the DOC in Ochtrup. The expansion, which increases the sales area from 11,500 to over 19,000 m², has raised concerns that are now set to be presented in court.
The expansion of the DOC in Ochtrup, a smaller medium-sized centre, has sparked debate due to its potential impact on the region. Critics argue that the centre significantly exceeds its medium-sized supply mandate with the expanded DOC, and that the disadvantages for the region due to the expansion are not considered justified.
Previously, the city of Gronau had filed a lawsuit against the building permit with the Administrative Court of Münster. Yesterday, the city of Nordhorn joined the legal battle, also filing a lawsuit against the expansion of DOC Ochtrup.
The affected municipalities and districts have reviewed their options and are preparing for legal processes, with discussions held about filing a norm control application against the building plan and an appeal against the building permit. The impact prognosis for the expansion project has been criticised for underestimating the impacts of the DOC and not taking into account the current and future development of online trading.
Critics also raise concerns about an insufficient assessment of the sales-related impacts of the DOC expansion. Urban planning consequences for inner cities and town centres in the catchment area are criticised as being inadequately considered.
In the planning phase, 21 municipalities and 3 districts jointly opposed the massive expansion plans of the DOC due to a lack of regional compatibility. The participants in the regional exchange agree that the expansion project is an attack on inner cities and town centres facing challenges from online trading.
However, the search results do not provide specific information on which courts are involved in the legal disputes by the surrounding municipalities and districts against the DOC Ochtrup expansion project. As the legal proceedings unfold, it remains to be seen how the courts will rule on these contentious issues.
