The UK Gambling Commission (UKGC) is currently experiencing a cringe-worthy moment of realisation. The organisation, once affiliated with business tycoon Richard Desmond, might be regretting the day they crossed paths in early 2022. At the time, Desmond was among multiple parties suing the commission for awarding the National Lottery contract to Allwyn Entertainment[1].

Fast forward to this week, Desmond has re-emerged to cast a shadow over the UKGC. The commission's competence is being questioned due to a legal fiasco that seems to be self-inflicted, or as the allegations suggest, internal design.

Following a slip-up by UKGC's legal team, over 4,000 sensitive documents relating to the lottery lawsuit were accidentally sent to Desmond's legal team[2].

Now, lawyers for Desmond's Northern & Shell subsidiary are requesting permission to amend their complaint, incorporating some of the sensitive documents in their £200m ($255m) lottery suit against the UKGC[2].

Desmond's legal team is hinting that the internal disclosure was not an accident. They are presenting evidence suggesting a UKGC source may have intentionally sent the sensitive documents[2].

Northern & Shell attorney Sa'ad Hossain KC reiterated this claim, stating the sensitive documents had passed inspection from senior lawyers[2]. He vehemently argued that the documents were disclosed to them intentionally.

This turn of events poses a significant question mark over the UKGC's competence and integrity.

A little secret?

Interestingly, the problems brewing for the UKGC from Desmond's corner come with a dash of intrigue. Towards the end of last year, reports surfaced that the regulator was holding secret meetings with Northern & Shell with intentions to settle the £10m ($12.9m) claim[3].

However, Desmond didn't bite, setting the stage for a public showdown with the national regulator[3].

On the other hand, at this week's pre-trial hearing, the UKGC's attorney, Tamara Oppenheimer KC, implored all parties to "maintain a sense of decorum and honesty" in the proceedings[4].
