The Regional Court in Berlin is currently dealing with an appeal regarding the eviction of apartments in the partially occupied house at Rigaer Straße 94. On Wednesday, more eviction lawsuits against the residents of Rigaer Straße 94 were discussed, marking a continuation of the ongoing legal battle over the left-wing housing project, commonly known as Rigaer94.

In the previous proceedings, out-of-court settlements were reached in which the leaseholders had withdrawn, requiring Lafone Investment Limited to initiate its own eviction lawsuits against the current residents. However, the court has already dismissed as inadmissible the lawsuits brought forth by Lafone Investment Limited in the previous proceedings.

Judge Sebastian Pörschke has expressed doubts about the validity of the power of attorney filled out by the presumed managing director Lisa Close, as there is no evidence that Close actually represents the investment basics. Additionally, the true seat (registered office) of Lafone Investments Limited and the location where its decisive decisions are made are not explicitly detailed. Leonid Medved, officially recorded in April 2025, is the majority shareholder with 75% or more ownership, implying that key decisions are likely influenced or controlled by him.

Another point of contention in court is whether the administrative seat of Lafone Investments Limited is in the UK or Germany. Lawyer Markus Bernau has expressed concern that discussions about the administrative seat of Lafone Investments Limited may infringe on the owner's property rights and finds it alarming.

In a bid to reach a resolution, Judge Sebastian Pörschke has advocated for both sides to agree on a long-term usage arrangement to avoid further litigation. He also suggested that if Lafone Investments Limited provides all necessary evidence and the eviction lawsuit against the 'Kadterschmiede' is deemed admissible, an eviction would be imminent.

The court will announce its decision on October 8. In the meantime, Lawyer Daniela Rohrlack attempted to reassure Markus Bernau by comparing Germany's liberal traffic regulations to other countries' restrictive fidelity investments.

Despite the ongoing legal battle, the future of Rigaer94 remains uncertain.

David Rojas Kienzle, a shell company not identified, is seeking to evict residents from Rigaer94. The property company Lafone Investments Limited is involved in the proceedings and has threatened to fail due to disputes over their lawyers' power of attorney. The management in the UK is claimed to have a straw man function, and Lafone Investment Limited is said to be a letterbox company to protect the actual owner who acts from Berlin.

The Regional Court had already rejected an eviction lawsuit against the Kadterschmiede in 2022, and this decision was confirmed by the higher instance, the Berlin Court of Appeals. The court also discussed the admissibility of an eviction lawsuit against the 'Kadterschmiede' on Wednesday. As the legal proceedings continue, the residents of Rigaer94 and their supporters remain hopeful for a favorable outcome.
